The "Human First" AI Policy (The 15% Rule)
While we love and respect AI as a tool for tagging, searching, and organizing, it is not a replacement for humans making music for other humans. By uploading a track to The Scene, you represent and warrant that no more than 15% of the audio on the track is AI-generated.
If we determine you are flooding the platform with fully AI-generated tracks, your account will be terminated.
Rights, Royalties, and Personal Use
You must own or control 100% of the rights to everything you upload.
- No Unauthorized Covers: Do not upload covers or uncleared samples unless you have the written legal licenses to do so.
- Personal Use & Commercial Broadcasts: The Scene is provided strictly for personal, non-commercial listening. We do not grant commercial public performance licenses. If a third party (such as a bar, restaurant, or retail store) wishes to broadcast your tracks in a public, commercial space, that venue is solely responsible for securing the appropriate public performance blanket licenses from the relevant Performing Rights Organizations (e.g., ASCAP, BMI, SESAC, GMR). You acknowledge that The Scene is strictly a hosting platform and is not liable for collecting or paying public performance royalties on behalf of venues streaming your music.
- Your Responsibility: You are solely responsible for clearing all rights and paying all producers, bandmates, and sample owners. The Scene is strictly a hosting and discovery platform; we are not liable for any breach of contract between you and third parties.
How You Get Paid (The 50/50 Split)
We believe in a fair ecosystem. The Scene pays artists on a monthly basis based on the prior month's play metrics and revenue.
As per your Artist Agreement, you will receive 50% of the ad revenue generated by your music on the platform. Payments will be processed via our third-party payment providers to your designated bank account.
Platform Limits and Storage
Running an audio-heavy app and AI database takes massive server power. Therefore, The Scene reserves the right, from time to time, to limit the number of songs you can upload, or cap the maximum length of songs, as we see fit to maintain business operations and server health.
Zero Tolerance for Hate
The Scene is about human connection through music. Hate speech, harassment, and toxic rhetoric will not be tolerated.
We reserve the right to immediately suspend or expel any user or artist if we determine, in our sole discretion, that you are not a good community member. There is no appeal process for hate speech.
Termination of Service & Fraud
You can delete your account at any time. We reserve the right to terminate or suspend your access to the Service at any time, for any reason, without notice. If your account is terminated for violating our Zero Tolerance for Hate policy or the 15% AI rule, your account will be closed, and a final payout of your accrued, legitimate revenue will be issued during the next standard billing cycle.
If we determine, in our sole discretion, that your streams were generated via click-fraud, bots, or artificial listening mechanisms, you will forfeit any outstanding revenue tied to those fraudulent activities.
Limitation of Liability & Governing Law
The Service is provided "as is" and "as available." To the maximum extent permitted by law, The Scene LLC, CSCD LLC, and our partners shall not be liable for any lost data, server downtime, or indirect, incidental, or consequential damages.
Our total liability arising out of or relating to your use of the platform shall not exceed $100.00 USD; PROVIDED, HOWEVER, that this limitation does not apply to any undisputed, accrued revenue share owed to you under the 50/50 split detailed in Section 3, which shall be paid in full.
These Terms are governed by the laws of the State of Oregon.
