What Data Does The Scene Collect?
We categorize the data we collect into two distinct types:
- Direct Contact & Account Data: Name, username, email address, password, profile settings, and payment details (processed securely by third parties like Stripe). We never share this direct contact information with advertisers.
- App Usage & Device Data: Saved playlists, uploaded audio files, AI search prompts ("vibe" searches), IP addresses, device identifiers (Device IDs), and general application interaction logs.
How We Process Data with Artificial Intelligence
Because The Scene utilizes advanced Artificial Intelligence to curate the ultimate listening experience, we process data in the following unique ways:
- Audio Tagging & Playlists: When an Artist uploads a track, the audio file is securely sent to our enterprise AI partners to generate descriptive tags. When a User searches for a "vibe," that text query is processed by our AI to curate a custom playlist.
- Model Training Protections: We utilize enterprise-grade API agreements with our third-party AI providers (e.g., Google Cloud/Gemini). Under these enterprise terms, your uploaded audio files and personal search queries are explicitly excluded from being used to train their public, foundational AI models.
For Which Purposes Will We Use Your Data?
- To provide, operate, and maintain the Service.
- To curate AI-driven playlist generation and audio tagging.
- To set up user accounts, artist profiles, and process payouts.
- To serve contextual and targeted advertising to keep the platform accessible and pay our artists.
- To ensure the security of our database and prevent fraud.
- To comply with legal obligations and enforce our Terms of Service.
How We Share and "Sell" Your Data
We share your data to provide the Service and support our business model. Under certain state laws, including the Oregon Consumer Privacy Act (OCPA) and California Consumer Privacy Act (CCPA), sharing specific app usage data for advertising purposes is considered a "Sale" or "Sharing" of personal information.
- Advertising (The "Sale/Share"): We share pseudonymized App Usage & Device Data (such as your device identifier and listening context) with third-party ad networks to serve you relevant, targeted advertisements. We absolutely never send your name, email address, or personal contact information to our advertising partners. You have the right to opt-out of this data sharing (see Section 6).
- Service Providers: We share necessary data with third-party vendors who perform services on our behalf under strict data processing agreements. This includes cloud hosting (Google Firebase), AI processing (Google Cloud), and payment processing (Stripe).
- Our Parent Company: We share data with our parent holding company, CSCD LLC, for centralized secure storage and corporate infrastructure management.
- Public Profiles: Artist names, public biographies, and public playlists will be visible to other users.
- Legal Compliance & Transfers: We may disclose information if required by law, or in the event of a merger, acquisition, or sale of assets.
Data Security & Storage
We use industry-standard physical, managerial, and technical security measures to protect your data. However, no internet transmission is 100% secure. You are responsible for protecting your account password.
Your Privacy Choices and Rights
Depending on your state of residence (including Oregon and California), you possess specific legal rights regarding your data:
- Right to Opt-Out of Sale/Sharing: You have the right to direct us not to share your device and usage data for targeted advertising. You can exercise this right by toggling the "Do Not Sell or Share My Personal Information" switch in your app profile settings. If you opt out, you will still see ads, but they will be generic, non-personalized ads based only on the current context of the app.
- Universal Opt-Out (GPC): We automatically recognize and honor Global Privacy Control (GPC) browser signals as a valid opt-out request for targeted advertising.
- Right to Know (Specific Third Parties): Oregon residents have the right to request a list of the specific third parties (not just broad categories) with whom we have shared their personal data.
- Right to Access & Deletion: You have the right to request access to the data we hold about you and request its deletion.
- Right to Non-Discrimination: We will not deny you goods or services for exercising your privacy rights.
